Terms & Conditions

§1. General provisions

  1. The Shop available at www.ciechorski.com is operated by Michał Ciechorski, conducting non-registered business activity under Article 5 of the Polish Entrepreneurs’ Law Act of 6 March 2018.
  2. Seller’s address: ul. Śląska 35/30, 80-379 Gdańsk, Poland.
  3. The workshop is located at ul. Wassowskiego 16, 80-225 Gdańsk, Poland. Personal collection is available by prior arrangement only.

  5. Address for returns and correspondence concerning complaints: ul. Śląska 35/30, 80-379 Gdańsk, Poland. Returns may also be sent to InPost Parcel Locker GDA10N after prior arrangement.
  6. The Seller can be contacted Monday to Friday, 9:00–17:00.
  7. Jewellery is handmade, primarily from 925 sterling silver and, depending on the product, from other materials specified in the individual product description.
  8. All products are new and offered in accordance with their description, specifications and applicable law.
  9. By placing an order, the Customer confirms that they have read these Terms & Conditions.

§2. Handmade character of the products

  1. Handmade jewellery may vary slightly from one piece to another in texture, patina, stone shade, surface or other details resulting from the handmade production process.
  2. Such differences are a natural characteristic of handmade products and do not constitute a lack of conformity with the contract where they are consistent with the product description, specifications and character of the design.
  3. Product photographs are for illustrative purposes. Enlarged photographs may affect the perception of the actual proportions and size. The information provided in the product description, in particular dimensions and specifications, is decisive.

§3. Orders and conclusion of the contract

  1. The Shop is available 24 hours a day, except during technical interruptions.
  2. Orders can be placed without creating an account.
  3. The Customer must provide accurate information necessary for the proper fulfilment of the order.
  4. Placing an order involves selecting the product, delivery and payment method, providing the required delivery details, accepting these Terms & Conditions and using a button confirming the purchase with an obligation to pay, or a button with equivalent wording.
  5. The sales contract is concluded when the Seller confirms acceptance of the order for fulfilment.
  6. If an order remains unpaid for 14 days, the Seller may cancel it.

§4. Prices and payments

  1. All prices shown in the Shop are gross prices and are stated in PLN or EUR.
  2. The price binding on the Customer is the price shown in the order summary before the order is placed.
  3. Available payment methods are shown during checkout and may include electronic payments, BLIK, traditional bank transfer and cash on delivery.
  4. Electronic payments and BLIK mobile payments are processed by CashBill, operated by CashBill S.A. based in Katowice (ul. Sobieskiego 2, 40-082 Katowice, Poland, NIP: 6292410801, REGON: 241048572, KRS: 0000323297).
  5. The Seller may change prices and run promotional campaigns. Such changes do not affect orders placed before the changes take effect.

§5. Order fulfilment and delivery

  1. Products are made to order unless the product description states that a particular piece is available for immediate dispatch.
  2. The standard production time is 7–10 business days from receipt of payment.
  3. If a product is ready earlier, it may be dispatched earlier.
  4. Additional processes, such as casting or gold plating, may extend the production time. The Customer will be informed accordingly.
  5. For products made according to individual arrangements, the production time is agreed separately.
  6. The carrier’s delivery time should be added to the production time.
  7. Within Poland, delivery may be made via InPost, DPD Pickup or courier, according to the options available at checkout. Personal collection from the workshop is also possible by prior arrangement.
  8. For international orders, available delivery methods and their costs are shown at checkout.
  9. The standard delivery cost is shown before the order is placed.
  10. Delivery within Poland is free for orders from PLN 390, and delivery to European Union countries is free for orders from EUR 300, unless otherwise stated for a particular order.
  11. If a parcel is not collected for reasons attributable to the Customer, re-dispatch may require payment of the additional delivery cost.

§6. Right of withdrawal

  1. A consumer who concludes a distance contract has the right to withdraw from the contract without giving a reason within 14 days, subject to statutory exceptions.
  2. For a contract concerning a single product, the 14-day period begins when the consumer, or a third party indicated by the consumer other than the carrier, receives the product.
  3. The right of withdrawal does not apply to a non-prefabricated item made according to the consumer’s specifications or intended to meet the consumer’s individual needs, in accordance with Article 38(3) of the Polish Consumer Rights Act.
  4. A withdrawal statement may be sent by email to ciechorski.jewellerystudio@gmail.com or submitted using the withdrawal form available in the Shop.
  5. The returned product must be sent back without undue delay and no later than 14 days after the withdrawal statement has been submitted.
  6. Returns should be sent to: Ciechorski Rough Jewellery, ul. Śląska 35/30, 80-379 Gdańsk, Poland. After prior arrangement, a return may also be sent to InPost Parcel Locker GDA10N.
  7. The consumer bears the direct cost of returning the product unless applicable law provides otherwise or the Seller has agreed to bear that cost.
  8. The Seller will reimburse all payments received from the consumer, including the cost of the cheapest standard delivery method available in the Shop, no later than 14 days after receiving the withdrawal statement. The refund will be made using the same payment method used by the consumer, unless the consumer has expressly agreed to another method that does not involve additional costs.
  9. The Seller may withhold the refund until the returned product has been received or the consumer has provided proof of returning it, whichever occurs first.
  10. The consumer is liable for any reduction in the value of the product resulting from handling beyond what is necessary to establish its nature, characteristics and functioning.

§7. Lack of conformity and complaints

  1. The Seller is liable to the consumer for a lack of conformity of the product with the contract in accordance with the Polish Consumer Rights Act.
  2. A complaint may concern any lack of conformity with the contract, not only technical damage. For handmade jewellery, natural differences resulting from the handmade character of the product do not constitute a lack of conformity where they are consistent with the product description, specifications and character.
  3. A complaint may be submitted in any form. For easier handling, the Customer is asked to email ciechorski.jewellerystudio@gmail.com with the order number, a description of the problem and, where possible, photographs.
  4. The product subject to a complaint must be made available to the Seller. The method of delivery or shipment will be agreed individually. Where repair or replacement is required, the costs required by law are borne by the Seller.
  5. The Seller will respond to a consumer complaint within 14 days of receiving it.

§8. Personal data

  1. The controller of personal data is Michał Ciechorski, ul. Śląska 35/30, 80-379 Gdańsk, Poland.
  2. Personal data is processed for order fulfilment, online payment processing and security (transferred to CashBill S.A.), delivery, returns and complaints, customer communication and compliance with legal obligations.

§9. Out-of-court dispute resolution

  1. Consumers may use available out-of-court methods of resolving consumer disputes, including assistance from a local or district consumer ombudsman or the competent regional Trade Inspection authority in Poland.
  2. Information about available amicable dispute-resolution procedures is also available from the Polish Office of Competition and Consumer Protection (UOKiK).

§10. Final provisions

  1. Contracts are concluded in Polish or English, depending on the language version of the Shop and the arrangements with the Customer.
  2. Polish law applies, subject to mandatory provisions protecting consumers.
  3. Matters not regulated by these Terms & Conditions are governed in particular by the Polish Civil Code and the Polish Consumer Rights Act.
  4. Amendments to these Terms & Conditions do not affect rights acquired under orders placed before the amendments take effect.
  5. These Terms & Conditions take effect upon publication in the Shop.
